Nicolette A. Kramer

Nicolette is a solo practitioner. She received her Bachelor of Arts degree from Manhattan College and earned her Juris Doctorate degree from the Shepard Broad College of Law at Nova Southeastern University. Before starting her own firm, she gained experience as the senior associate at a boutique law office that focused solely on the rights of planned communities. Nicolette has been a member of the Florida Bar since 2011 and is also admitted to practice before the United States District Courts for the Middle and Southern Districts of Florida.

Nicolette was elected to serve as 2024-2025 President of the Central Florida Association for Women Lawyers​​. She is an active member of the Orange County Bar Association, where she chaired the Health & Wellness Committee from 2020-2022, and the Orange County Teen Court Advisory Board, where she served as Vice President from 2021-2023.  She has been honored by her peers in the legal profession with various recognitions through recent years, including: Florida Association for Women Lawyers' 2021 Leader in the Law Award; Orange County Bar Association's 2021 Star of the Bar Award; and Super Lawyers Florida Rising Stars List 2021 and 2022.

Governing Documents

The restrictions, requirements, policies, and procedures contained within the provisions of community association governing documents have the largest impact on a subdivision's operations. When those provisions are ambiguous, outdated, or inadequate to address changing circumstances within the community, it may become necessary to amend the governing documents. 


Governing documents can be overwhelming and complicated, which is why it’s crucial to take an informed approach to their interpretation and amendment. Through this service offering, you can count on Nicolette to guide you in every step of the process.

Covenant Enforcement

Nicolette recognizes the importance of enforcing your community association's rules and restrictions. Avoiding costly litigation should be the primary focus for any community. Efforts taken to first resolve disputes through cost-effective mediation and alternative dispute resolution are required under Florida Law, but the process also helps promote community harmony.

The majority of disputes impacting HOAs and Condos can - and should - be resolved through skilled representation, negotiation, and dispute resolution procedures. However, when litigation does become necessary, Nicolette provides her clients with aggressive and responsive litigation services.

Collections

Assessment revenue is the lifeblood of every planned community. Boards of Directors have a legal duty to collect delinquent assessments in order to protect the interests of the community and the property values of its members.

Nicolette has proven herself to be a leader in collecting delinquent assessments for homeowners' associations and condominium associations. Her knowledge and experience provides innovative debt collection methods that adhere to Federal and Florida law.

Mortgage Foreclosure

Typically, when borrowers stop paying their mortgages, they usually also stop paying their assessments resulting in debts owed to the communities. Nicolette will work with lenders to speed up their foreclosure proceedings. This process helps get a new owner quickly into the property.

Interpretation of the underlying mortgage documents, an association's governing documents, and Florida law plays an important role in the successful recovery of monies toward unpaid assessments from a first mortgagee, its successor or assignee.  A sound understanding of Florida's "Safe Harbor" statute and case law is required to assist an association in the collection of unpaid assessments after mortgage foreclosure occurs. Nicolette welcomes the opportunity to meet with her clients at any time to walk through the mortgage foreclosure and estoppel processes.

Bankruptcy

Bankruptcy is intended to help the honest debtor seek a fresh start while treating all creditors equally. Unfortunately, delinquent owners, acting in bad faith, may file for bankruptcy just to stop a foreclosure sale. 

​

Nicolette seeks to protect her clients' secured interests by timely filing proofs of claim with bankruptcy courts. She also works to obtain relief from stay so that collections can proceed despite pending bankruptcy proceedings. 

​

​It is important to seek competent legal representation when an owner goes into bankruptcy to secure pre-petition debt, but it is just as important to correctly calculate post-petition amounts due and owing.  Attempting to collect, enforce, or otherwise pursue an owner for pre bankruptcy petition debt could be a violation of the automatic stay under the Bankruptcy Code.
